El Instituto Federal de Acceso a la Información (IFAI) informó que las empresas que tienen redes sociales en internet deberán cambiar sus políticas para proteger la integridad física y moral de niñas, niños y adolecentes mexicanos; en caso contrario, recibirán sanciones penales y económicas.

En un comunicado, la directora de Clasificación y Datos Personales del IFAI, Lina Ornelas, dijo que los menores de edad ignoran que compartir información con amistades en la red implica riesgos porque puede ser utilizada para otros fines, como la trata de personas, la pederastia y la pornografía, porque está almacenada por muchos años.

“Ellos creen que están en un espacio privado pensando que sólo comparten información con sus amigos, pero no son conscientes de que las empresas o la industria que ofrecen esos servicios (de redes sociales) la utilizan para venderles publicidad o para tener un segmento de mercado”, agregó.

Antes de imponer multas, dijo, lo que el IFAI quiere hacer es trabajar a favor de una cultura de la prevención para capacitar primero a las empresas para que conozcan la Ley Federal de Protección de Datos Personales en Poder de los Particulares, y cómo la deben cumplir.

“Donde haya una violación, el IFAI va aplicar multas y sanciones que prevé la ley”, dijo.

Instrumentos legales

Recordó que el IFAI cuenta ya con las herramientas legales para obligar a la industria a avisar a los niños que la información que suban a las redes sólo se va usar en esos espacios y no en buscadores abiertos, como Google o Yahoo!, si estos sitios no tienen un consentimiento expreso.

Destacó que si las políticas de las empresas no cambian, la información de los niños en Facebook podrá ser localizada en los buscadores abiertos, sin tener cuenta de aquel sitio.

“Esas políticas tienen que cambiar, como en Canadá, porque tuvieron un caso contra Facebook y encontraron 14 violaciones a las ley de privacidad canadiense. Por vía de la conciliación, el sitio está accediendo a cambiar sus políticas de privacidad”, comentó.
