Todo ciudadano tiene derecho legal a observar y documentar toda actividad pública.


Como hemos comentado anteriormente en este espacio la integración de las nuevas tecnologías a nuestra vida cotidiana ha traído consigo una serie de cambios en nuestra forma de  interactuar y relacionarnos con el entorno.
La posibilidad cada vez mayor de acceder a dispositivos móviles en sus diversas presentaciones: smartphones, tablets o notebooks con conexión a internet y acceso a redes sociales otorgan a los usuarios de estos aparatos  el poder de documentar los sucesos  que ocurren en su día a día tiempo real.

Esta característica adoptada por nuestra generación donde lo mismo publicamos en Facebook o Twitter fotografías y videos de felices acontecimientos como la llegada de un nuevo integrante a la familia, logros profesionales y académicos , así como recuerdos de las vacaciones en familia o un fin de semana de fiesta; también nos ofrece la posibilidad de documentar y reportar malas experiencias como: casos de abuso de autoridad, fallas en los servicios públicos como por ejemplo calles con baches, falta de recolección de basura, lámparas de alumbrado público en mal estado y actos presuntamente ilícitos cometidos por funcionarios, de tal forma que el hombre moderno trae en su bolsillo su propia herramienta para hacer denuncias ciudadanas.
Según datos del The Competitive Intelligence Unit  (CIU) a cierre de 2014 el número de usuarios de teléfonos inteligentes en México se tuvo un crecimiento de 52.6 millones. Este mismo estudio revela que de las 103.9 millones de líneas móviles activadas el año pasado el 50.6%  corresponden a smartphones con lo cual por primera vez en la historia la venta de estos aparatos superó a la de los “feature phones” que no son más que los celulares con menos tecnología, siguiendo la tendencia que se da en los países desarrollados.
Como podemos apreciar el estudio de CIU en nuestro país el acceso a los smartphones ha ido creciendo durante los últimos años de la mano con el número de denuncias públicas donde los ciudadanos haciendo uso de su teléfono celular han podido documentar situaciones que involucran a servidores públicos incurriendo en faltas y para muestra tres botones.

Ante una situación de acoso es muy importante conservar la calma, cuidar su integridad física y hacerle saber con educación a los elementos policiacos involucrados que desde el momento en que portan su uniforme dejan de ser particulares para ser  servidores públicos .
Aplican Restricciones
Las restricciones para documentar a través de video o fotografías presuntos actos delictivos por parte de funcionarios y servidores son validas para edificios públicos donde las medidas de seguridad del inmueble así lo requieran y donde se haga saber a los ciudadanos sobre las políticas de seguridad del lugar. Por ejemplo: bancos, aeropuertos y puentes fronterizos .
